HOA LETTER AMAZON ROAD

Subject: Proposed Access Control and Security Enhancements on Amazon Road

Dear [……] HOA Board Members,

On behalf of AM Management NV, a company of the Maho Group, I am writing to inform you of our decision to install a security booth and controlled access system at the entrance to Amazon Road, which serves as the primary access route to several communities in the Maho area. This initiative is intended to enhance the overall safety, organization, and long-term upkeep of the road and surrounding infrastructure, benefiting all residents and landowners who rely on this route.

As the area continues to develop, we believe that a gated entrance backed by professional security and RFID-based access can significantly enhance both security and the quality of life for residents. The enhancements include:

These measures will be carried out with minimal disruption and respecting the rights of all property owners in the area.

No capital investment is being requested from HOAs or property owners. The implementation will be fully financed by AM Management NV and its affiliated entities. However, ongoing operational costs are associated with these improvements, including staffing, system maintenance, and infrastructure upkeep. We intend for these to be equitably shared:

We recognize that even without formal easements, property owners' long-standing use of Amazon Road may imply de facto access rights. However, under the Civil Code and relevant jurisprudence, we are legally permitted to install fencing and gates (access control measures) for regulated access. Furthermore, users with de facto access rights are expected to contribute to the reasonable maintenance and operational costs. Our goal is to ensure that all rightful users can continue to access the area efficiently, safely, and without hindrance.

We are moving forward with implementation and welcome the opportunity to meet with your HOA to explain the next steps. Additionally, we would like to discuss practical access arrangements and timelines for successful implementation.

In preparation for this, we request that each HOA board provide an overview of the number of property owners it represents and the contact information for each owner, so that we can tailor our discussions and cost allocations accordingly. We kindly request that you share this information with us before June 24th, 2025.
